Terms and Conditions Acceptance and usage of Floor Estimating Solutions reports are subject to the following terms and conditions. Floor Estimating Solutions plans and or reports are always prepared in good faith, information is supplied to Floor Estimating Solutions from existing or intended clients for planning and estimation purposes. Floor Estimating Solutions has no way of independently checking and or verifying the accuracy of this information which often changes before commencement of any projects or as projects progress. Floor Estimating Solutions plans and or reports represent an opinion of one suggested installation layout or quantity based either on the existing or intended client’s instructions, or our experience within the industry, they are not intended to represent the only or the most economical way to complete the project. Floor Estimating Solutions under the direct direction of its existing or intended clients may produce an alternative to the original plans provided, whilst all details contained in Floor Estimating Solutions plans and or reports have been carefully prepared and is believed to be accurate, no warranty is given either expressly or implied by Floor Estimating Solutions. To the maximum extent permitted by the law, Floor Estimating Solutions, will not be liable for any loss, claims, damages, or costs (including legal costs and expenses on a full indemnity basis) of any kind, including but not limited to all, direct, special, indirect, incidental or consequential damages, or loss of profits or opportunity to any person, even if such loss or damages were reasonably foreseeable, or even if expressly advised of the possibility of such damages, arising out of or in connection with the use of, conclusions drawn from, any report provided by Floor Estimating Solutions. If this provision is unenforceable in whole or in part in any jurisdiction due to relevant laws, then in no event will the liability of Floor Estimating Solutions to you for any damages, losses, claims, or anything else exceed the lesser sum of AUD $1.00 and the amount paid by you for the original plans and or report. Without limitation to the foregoing and to the full extent permitted by law, Floor Estimating Solutions liability, if any, for any breach of a condition or warranty implied by the Trade Practices Act or similar state and territory legislation in Australia which cannot be excluded, is limited to any one or more of the following as determined by Floor Estimating Solutions in its absolute discretion: It is the responsibility of Floor Estimating Solutions' existing or intended clients to carry out sufficient checks to satisfy themselves that the architectural plans, the project site, and the client’s own instructions and Floor Estimating Solutions reports  and estimations are in agreeance before proceeding. Floor Estimating Solutions does not accept any responsibility for any errors in the information supplied to them, or for any subsequent changes to the plans or site conditions that may render the original estimates invalid. . Floor Estimating Solutions reports are for estimation purposes only and may not necessarily represent the area to be covered in its 'as built' or completed form. All reports are prepared for the exclusive use of existing or intended clients. They will not be reproduced in whole or in part without the express written authority from Floor Estimating Solutions or the existing or intended client or relied upon by any other party for any purpose. In the event that any part of these terms is found to be invalid or unenforceable for any reason, such invalidity or unenforceability shall not affect the validity or enforceability of any other part of these terms, which shall remain in full force and effect and shall be construed as if the invalid or unenforceable part were not part of the terms. An Invoice with banking details will be sent once plans are completed, once Floor Estimating Solutions is in receipt of payment then all plans and reports will be sent via email or post. Failure to make payment will result in Legal Action and all costs added to the sum of the original invoice amount. Only prior arrangements will avoid any such action.
